Peach House Pilates – Terms of Service & Liability Waiver

Effective Date: May 1, 2025

Welcome to Peach House Pilates! By booking a class, attending a session, or using any of our services, you agree to the following Terms of Service and Liability Waiver. Please read them carefully before participating.

1. Studio Services

Peach House Pilates is a boutique Pilates studio offering small-group, reformer-based classes focused on strength, control, and full-body sculpting. Our studio features 11 reformers and offers 4 to 12 classes per day, depending on the schedule.

We reserve the right to modify, suspend, or discontinue any part of our services at any time.

2. Booking & Attendance

• All classes must be reserved in advance through our online booking platform.

• You must have a valid class pack or membership on file to book.

• We do not accept bookings via text, email, voicemail, or social media.

• Please arrive at least 10 minutes before class, especially if it’s your first time.

• Clients arriving more than 10 minutes after class starts may not be admitted and may be marked as a no-show.

• If you’re added from the waitlist, our cancellation policies still apply. Please remove yourself from the waitlist if your plans change.

3. Cancellation & No-Show Policy

Clients must cancel their reservation at least 8 hours before class start time to avoid penalties. All cancellations must be made through our online booking system. We do not accept cancellations via text, email, or social media..Cancellations and no-shows are subject to the following policies:

3.1 Limited Membership Holders

• Late Cancellation (less than 8 hours’ notice): A $15 fee will be charged. The class credit will remain on the account.

• No-Show (failure to attend without canceling): A $25 fee will be charged. The class credit will remain on the account.

3.2 Unlimited Membership Holders

• Late Cancellation: A $15 fee will be charged.

• No-Show: A $25 fee will be charged.

3.3 Class Pack Holders

  • Late cancellations (less than 8 hours’ notice) and No-Shows (failure to attend without canceling) will result in loss of class credit.

3.4 Enforcement

Peach House Pilates reserves the right to suspend or terminate booking privileges for clients who repeatedly violate these policies.

4. Waitlist Policy

• If a class is full, join the waitlist!

  • If a spot opens up in the class, those on the waitlist will be automatically added into the class until 2 hours prior to the start of the class.

• If you’re added into a class, our cancellation/no-show policies apply.

• Remove yourself from the waitlist if your plans change.

• You can check your waitlist status by logging into your account.

5. Payment & Membership Terms

• All purchases are non-refundable and non-transferable.

• Class packs and memberships have firm expiration dates.

• Memberships auto-renew monthly unless canceled before the next billing cycle.

• Monthly memberships require a 3-month minimum commitment.

• Credits from monthly memberships do not roll over.

• Guest passes and promotions have set expiration dates and are not transferable.

• By providing a payment method, you authorize Peach House Pilates to charge your card for classes, fees, and penalties.

• Failed payments may result in frozen booking privileges.

6. Studio Etiquette

• Grip socks are required in all classes. We sell them in-studio if you forget!

• Wear appropriate workout attire (no jeans, streetwear, or sneakers).

• Clean your equipment after class using the sanitizers provided.

• Silence and store phones during class.

• Please treat staff, instructors, and fellow clients with respect.

7. Health & Safety

• You affirm that you’re in good physical condition and able to participate in exercise.

• Inform your instructor of any injuries, limitations, or pregnancy before class.

• Instructors may suggest modifications or deny participation based on safety concerns.

8. Photo & Media Release

We occasionally photograph and film classes for promotional purposes. By attending, you consent to the use of your image in our marketing. If you prefer not to be photographed, please notify us in writing.

9. Merchandise & Lost Items

• All merchandise sales are final (socks, apparel, etc.).

• We are not responsible for lost or stolen items. Contact us if you’ve left something behind.

10. Intellectual Property

All studio content, including but not limited to class programming, teaching methods, branding, and marketing materials, is the exclusive property of Peach House Pilates and may not be copied, reproduced, or used without written permission.

11. Privacy Policy

We are committed to protecting your privacy. Your personal information is used solely for managing bookings, processing payments, and providing studio updates. We will never sell or share your information without your consent.

12. Liability Waiver

Indemnification, Waiver, and Release of Liability

You hereby hold harmless, waive, release, and discharge Peach House Pilates LLC and all of its respective owners, shareholders, principals, directors, officers, members, managers, instructors, contractors, employees, and affiliates (collectively referred to as “Peach House Pilates”) from and against all liability, losses, costs, expenses, causes of action, claims, judgments, liens, litigation, penalties, orders, violations, and damages, including reasonable attorney’s fees, costs, and expenses arising out of or related to personal property damage or loss, personal bodily injury, and/or wrongful death, caused by negligence or otherwise (except to the extent caused by the willful misconduct or gross negligence of Peach House Pilates), sustained during any services or events (“Services”) offered by Peach House Pilates or while present on the premises located at 504 Arnold Avenue, Point Pleasant Beach, NJ 08742 (the “Premises”).

“Services” shall be understood and acknowledged to include, but are not limited to, all group Pilates classes, private sessions, special events, or any other offerings or activities hosted by Peach House Pilates.

You acknowledge and agree that this Indemnification, Waiver, and Release applies to all Services offered by Peach House Pilates. You further acknowledge that Peach House Pilates is not responsible for the safekeeping of any personal property brought into the studio.

By participating, you acknowledge the inherent mental and physical risks involved in group fitness and Pilates classes. You agree that your participation in any and all Services is entirely voluntary and at your own risk.

You further agree that neither you, nor your heirs, administrators, agents, or legal representatives will take legal action, sue, or initiate any claims against Peach House Pilates for any personal injury, property damage/loss, or wrongful death, whether or not caused by negligence or otherwise, except in the case of willful misconduct or gross negligence by Peach House Pilates.

13. Modifications to Terms

Peach House Pilates reserves the right to update or change these Terms of Service at any time. Updates will be posted to our website with a revised effective date. Continued use of our services after any changes constitutes your acceptance of the new terms.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey. Legal disputes will be resolved in Ocean County, NJ.
